Stack v Cognicase

Richard Stack was employed with Cognicase as a software developer. Through many prior corporate acquisitions, his employment stretched back 1.5 years. He was earning $65,000 per annum on his termination.

No cause was alleged. The only issue was how much severance he should receive. At the age of 62, his position was unique as most software types and younger in age.

Richard was able to sue, using the simplified rules for claims under $50,000. The case was set down for trial after the defence was filed.

It appears likely that this case will settle amicably.
